By accessing or using services provided by Piedmont Hosting ("we," "us," or "our"), including virtual private servers, game servers, web hosting, and any related services (collectively, "Services"), you ("Customer" or "you") agree to be bound by these Terms of Service. If you do not agree, do not use our Services.
We may update these Terms from time to time. Continued use of our Services after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or account notification.
You must be at least 18 years of age to use our Services. By creating an account, you represent that you are at least 18 years old and that all information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for losses resulting from unauthorized account access that is not caused by our negligence.
We provide infrastructure hosting services including, but not limited to, virtual private servers, game server hosting, and web hosting. While we strive for high availability, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance when possible.
We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation of Services.
All prices are listed in US dollars. Subscriptions are billed on a recurring monthly or annual basis depending on your selected plan. Payments are processed through our third-party payment processor, Stripe.
You authorize us to charge your payment method on file for all applicable fees. If payment fails, we may suspend your Services after a reasonable grace period. We reserve the right to change pricing with 30 days' notice.
We offer a 7-day money-back guarantee for new customers on their first service. Refund requests must be submitted via a support ticket within 7 days of the initial purchase. Refunds are not available for renewals, add-ons, or services that have violated our Acceptable Use Policy.
You may cancel your Services at any time through your account dashboard or by contacting support. Upon cancellation, your service will remain active until the end of the current billing period. After that period, your server and all associated data will be permanently deleted.
We are not responsible for backing up your data. It is your sole responsibility to maintain backups of any data stored on our servers.
Your use of our Services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. You retain ownership of all data you store on our servers. We do not access, monitor, or share your data except as required by law or as necessary to provide and maintain our Services.
To the maximum extent permitted by law, Piedmont Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our Services.
Our total liability for any claim arising from these Terms or our Services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Piedmont Hosting, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.
All content, branding, and materials on our website and Services are owned by Piedmont Hosting and protected by applicable intellectual property laws. You may not copy, modify, or distribute our materials without written permission.
You retain full ownership of any content or data you upload, store, or transmit through our Services.
We may suspend or terminate your account and access to Services immediately, without prior notice, if you breach these Terms or our Acceptable Use Policy, fail to pay fees when due, or engage in activity that is harmful to our infrastructure or other customers.
Upon termination, your right to use our Services ceases immediately. We may delete your data after a reasonable period following termination.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Durham County, North Carolina.
